In the following cases the Court has reached the same findings as in similar cases raising the same issues under the Convention:
The applicants, Mario Morea, Cesare Morea and Paola Morea, are Italian nationals who were born in 1944, 1928 and 1930 respectively and live in Mottola and Putignano (Italy).
They alleged that they had been deprived of their land in circumstances incompatible with Article 1 of Protocol No. 1 (protection of property). They further alleged an infringement of their right to a fair hearing as guaranteed by Article 6 § 1.
The Court held that there had been a violation of Article 1 of Protocol No. 1 and that it was not necessary to examine the merits of the complaint under Article 6 § 1.
